Aquanta Vision, Inc. ("the Company," "we," "us," or "our") provides AI-powered methane and emissions monitoring software for midstream and upstream energy operators. This Privacy Policy explains what personal information we collect through aqunatavision.com (the "Site") and our client portal, how we use it, and the choices available to you. It applies to information collected through the Site and through direct communications with us, and it covers both the marketing website and the operator-facing portal where clients configure monitoring sites, review sensor data, and access compliance reports.

2. Information We Collect

2.1 Information You Provide

We collect information you submit directly, including:

• Contact details (name, work email, phone number) when you request a demo, fill out a contact form, or enroll in our early-access program;
• Company and operational context you choose to share (employer, role, number of production sites, compliance requirements, project scope);
• Client portal credentials (username, hashed password) for operators who access the monitoring platform;
• The content of any messages, feedback, or support requests you send us.

2.2 Emissions Monitoring and Sensor Data

Our core service processes sensor data and emissions telemetry submitted by operator clients through the platform. This includes continuous methane concentration readings, sensor array configurations, site metadata (facility type, geographic region, monitored component lists), and alert event logs. This operational data is processed solely to generate leak detection alerts, source-attribution reports, work order routing, and LDAR compliance documentation for the contracting operator. We do not use client sensor or emissions data to train models without explicit written consent from the contracting operator, and we do not share it with third parties except as required to deliver the contracted service or as required by law.

2.3 Information Collected Automatically

When you visit aqunatavision.com, we automatically collect limited technical information:

• IP address and approximate location (city or region level);
• Browser type, operating system, device class;
• Pages visited, referring URLs, time on page;
• Cookie and similar identifiers (see Section 5 and our Cookie Policy).

2.4 We Do Not Knowingly Collect Children's Data

aqunatavision.com is directed to energy industry professionals and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact [email protected] and we will delete it promptly.

3. How We Use Information

We use the information we collect to:

• Respond to demo requests, pilot inquiries, and technical questions from energy operators and EHS professionals;
• Provision and operate the Aquanta Vision monitoring platform for contracting operators, including delivering real-time leak alerts, source-attribution reports, and LDAR compliance documentation;
• Route work orders to field crews based on source-pinning results;
• Send service notifications, platform updates, and (with your consent where required) industry-relevant communications such as regulatory guidance on EPA OOOOb and LDAR requirements;
• Measure and improve the performance and reliability of the Site and platform;
• Detect, investigate, and prevent fraudulent or abusive access attempts;
• Comply with applicable legal obligations, including regulatory recordkeeping requirements applicable to our business.

We do not sell personal information for monetary value. Where applicable state law treats certain advertising arrangements as a "sale" or "share," see your state's section below.

4. Sharing of Information

We share personal information only with:

• Service providers acting on our behalf (for example, cloud hosting, email delivery, and analytics providers) under contractual confidentiality and data-processing terms;
• Regulatory authorities or law enforcement, when required by law or necessary to protect rights, safety, or property;
• A successor entity in the event of a merger, acquisition, or sale of substantially all assets, subject to this Policy.

We do not sell personal information to third parties. Client sensor and emissions data is never shared with third parties outside the contracted service delivery chain without the operator's explicit written authorization.

5. Cookies and Tracking

We use cookies and similar technologies to operate the Site, remember preferences, and measure aggregate usage. For details and choices, see our Cookie Policy. The Site uses a notice-based consent model; analytics cookies are active by default but you may opt out through the cookie banner or your browser settings.

6. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy, to meet legal or accounting obligations, and to resolve disputes. Demo inquiry and marketing-list contacts who have not engaged with us in 24 months are purged from our active systems. Site access logs are retained for 90 days and then aggregated or deleted. Operator client data retention schedules are governed by individual service agreements, with minimum retention aligned to the recordkeeping obligations applicable to oil and gas emissions monitoring under applicable EPA reporting rules.

7. Security

We use administrative, technical, and physical safeguards designed to protect personal and operational information, including TLS encryption in transit, restricted-access databases, and least-privilege access controls for platform personnel. No system is perfectly secure; we cannot guarantee absolute security against all threats.

8. Your General Rights

Depending on your jurisdiction, you may have rights including access, correction, deletion, and the ability to limit certain processing. To make a request, email [email protected]. We will respond within the timeframe required by applicable law.

9. Texas Residents (TDPSA)

Under the Texas Data Privacy and Security Act ("TDPSA"), Texas residents have the rights described below regarding personal data we control or process.

9.1 Your TDPSA Rights

• Right to Confirm and Access: confirm whether we are processing your personal data and obtain access to it.
• Right to Correct: correct inaccuracies in your personal data.
• Right to Delete: request deletion of personal data we have collected from or about you.
• Right to Data Portability: obtain a portable copy where we maintain it electronically and where technically feasible.
• Right to Opt Out: opt out of targeted advertising, sale of personal data, and profiling for decisions producing legal or similarly significant effects. We do not engage in any of these activities.

9.2 Sensitive Data Consent

If we ever process sensitive data as defined under TDPSA (e.g., precise geolocation, biometric, health data), we will obtain your prior consent. The Service does not currently process such data about individual natural persons; operational sensor coordinates are facility-level data associated with contracting operator entities, not individual residents.

9.3 How to Exercise

9.4 Appeal

If we deny your request you may appeal by replying to our response. If denied on appeal, you may contact the Office of the Texas Attorney General Consumer Protection Division.

9.A California Visitors

If you are a California resident, you may also exercise the rights granted under the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. We do not sell personal information and do not "share" personal information for cross-context behavioral advertising.
